Greenaction Files Lawsuit Against US Navy and EPA on Hunters Point Cleanup
“Representatives from Greenaction for Health Environmental Justice have told the Chronicle that the group plans to file a lawsuit in federal court on Friday naming the U.S. Navy, which is responsible for cleaning the roughly 500-acre shipyard on the city’s southeastern waterfront in preparation for its planned redevelopment, and the Environmental Protection Agency, or EPA, which oversees the effort.
Greenaction has been urging the Navy and EPA to adopt updated remedies, and announced its intent to sue in December. The lawsuit accuses the agencies of violating the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) — a federal law governing the cleanup of abandoned hazardous waste, or “Superfund,” sites and requires selected cleanup remedies and goals to be evaluated and, if required, updated every five years.
According to Greenaction’s lawsuit, the Navy has missed key deadlines for reviewing its work plans, and the EPA has failed to enforce its cleanup agreement with the state of California and the Navy.”
